TECH - Building Code Meeting Briefs

The Task Group on Secondary Suites (TG-SS) met to advance discussions on harmonizing variations in code requirements with the goal being to remove the National Building Code (NBC) floor area limit for secondary suites.

TG Members generally supported removal, contingent on compensating safety measures such as enhanced fire-resistance ratings (e.g., 45-minute separations), and interconnected smoke alarms. The task group emphasized that safety objectives—particularly fire and life safety—must be preserved or improved if regulatory limits are relaxed.

Jurisdictional approaches were reviewed, including Ontario’s performance-based model, British Columbia’s integration of suites into new construction, and Alberta’s requirements consolidated in a Standata. Discussions highlighted the importance of maintaining consistency while allowing flexibility for local enforcement and housing needs. The TG also considered, but did not support, introducing occupancy or bedroom limits within the building code, noting these are more appropriately addressed through municipal bylaws. 

Additional technical discussions addressed fire separations for exits, treatment of ancillary spaces, and challenges with firewall requirements in row housing. One of the provincial government reps noted that industry had told them to consider the impact on housing supply when developing code requirements which are supposed to be minimum requirements versus best practice requirements. 

The TG agreed to continue refining proposals with ongoing coordination across committees. CHBA stressed the importance of the provincial government representatives to consult with industry in their respective provinces.
